MEDICAL LEAVE AND VARIABLE INCENTIVE SYSTEMS
Recently, the Labor Directorate (Ord. 92) reiterated the inappropriateness of establishing a remuneration incentive system that makes the obtaining of the benefit or remuneration depend on the circumstance that the employee does not use medical leave or does not use the legal holiday, given the non-renewable nature of such rights.
Consequently, the calculation of variable incentives for those workers who take medical leave must be made considering the proportion of days worked, without including in the calculation factors that do not respect this proportionality.
