CLARIFICATION ON OVERTIME COMPENSATION WITH ADDITIONAL HOLIDAYS
On March 28, 2005, the Labor Directorate (Opinion 199/05) clarified some aspects regarding the compensation of overtime with additional days of holidays, as contemplated in the 40-hour Law.
1. Regarding the annual limit of 5 additional days of holiday generated by compensation with overtime, it was clarified that the period is for each year of the contract and not for each calendar year.
2. The additional holiday generated by the compensation cannot be divided into half days or holiday hours.
