The second part of Law No. 21,595, known as « Economic Crimes Law », enters into force and penalizes the company for the commission of the offenses indicated in the law.
It should be noted that Law 20.393 on corporate criminal liability was previously published. It is worth asking, then, what are the differences between the two laws.
The differences are not of substance, since both punish the commission of crimes by companies. The big difference lies in the fact that Law 21,595 exponentially increases the number of crimes that are sanctioned as of August and in some cases increases the penalties for some offenses.
What can be done in this situation? Have a proactive behavior and create a crime prevention manual with all the formalities required by law and a proper ongoing training of all employees of the company.
