CHILEAN LABOR LAW ONLY APPLIES WITHIN THE TERRITORY OF THE REPUBLIC
Companies domiciled in Chile that have employees living abroad must take into account that Chilean labor legislation is only applicable within the national territory. Currently, our legislation does not recognize the figure of “digital nomads” as other countries, such as Spain, which has a Visa for Spanish residents who work remotely for foreign companies.
On the other hand, workers who work outside Chile for a Chilean company are subject to the laws of the country where they reside, although their activities may have an impact in Chile.
It is essential to know the rights and obligations under the laws of the country where the worker resides, as Chilean labor law has jurisdiction only within the country.
This understanding is crucial to ensure proper compliance with labor regulations for both companies and workers in international contexts.
