During June, a Canadian court upheld a breach of contract claim against a company, holding that a thumbs-up emoji (?) represented an expression of contractual consent and a type of electronic signature, to the extent that it identified the signatory and conveyed an acceptance.
In Chile, the general rule is that contracts do not need to be written to exist (consensual), so a thumb emoji could come to be considered as an expression of contractual consent.
To avoid inconveniences, it is advisable to have a written and signed contract.
