IS IT POSSIBLE FOR WORKERS TO USE THEIR OWN TECHNOLOGICAL MEANS FOR THE DEVELOPMENT OF THEIR FUNCTIONS?
The TD ruled on the use of personal cell phones, reiterating that workers are allowed to use their own electronic equipment for the development of their work. For these purposes, it is necessary that:
(i) The workers give their consent (in writing);
ii) The employer assumes all the costs of the use of the personal electronic equipment.
iii) The employer does not access the employee’s personal information.
